(Oral) This order shall dispose of two criminal miscellaneous petitions i.e. CRM-M-18739-2025 and CRM-M-25483-2025 as they arise out of the same FIR. 2. The petitioner-Harpreet Singh alias Sunny (in CRM-M-18739- 2025) and the petitioner-Gurwinder Singh @ Bawa (in CRM-M-25483- 2025) seek the grant of regular bail under Section 483 of BNSS, 2023 in case bearing FIR No.55 dated 10.04.2024 under Sections 419, 420, 465, 467, 471, 120-B IPC registered at Police Station Sadar, District Hoshiarpur. For the sake of convenience, the facts are being taken from the petition bearing No. CRM-M-18739-2025. 4. The brief facts of the case are that a tip-off was received by the police party that the petitioners alongwith their co-accused used to attest fake bail/surety bonds, Aadhar Cards, Identity Cards and Jamabandis and if a raided, they could be nabbed. The police party raided the disclosed place and apprehended the accused. 5. The learned counsel for the petitioners contends that the petitioner are in custody since April, 2024, the investigation stands completed but none of the 11 prosecution witnesses have been examined so far. Two co-accused, namely, Amandeep Singh @ Micky and Simarjit Singh Simma have been granted the concession of regular bail by this Court vide orders dated 05.03.2025 (Annexure P-3) and 08.05.2025 respectively whereas the petitioner-Harpreet Singh @ Sunny (in CRM-M-18739-2025) has been granted the concession of interim bail by this Court during the pendency of this petition vide order dated 21.04.2025. As the petitioners are similarly situated, they too are entitled to the concession of regular bail. 6. The learned counsel for the State, on the other hand, contends that the allegations against the petitioners and their co-accused are grave and therefore, they are not entitled to the concession as prayed for. He, however, concedes that the petitioners are in custody since April 2024, none of the 11 prosecution witnesses have been examined so far and that two co-accused have been granted the concession of regular bail. Admittedly, the case of the petitioners is triable by the Court of a Magistrate. The petitioners are first-time offenders, in custody since April 2024 but none of the 11 prosecution witnesses have been examined so far. Therefore, the Trial of the present cases is not likely to be concluded anytime soon. Two co-accused of the petitioner have been granted the concession of bail. In this situation, the further incarceration of the petitioners is not required. 9. Thus, without commenting upon the merits of the case, the present petitions are allowed and the petitioners, namely, Harpreet Singh alias Sunny (in CRM-M-18739-2025) and Gurwinder Singh alias Bawa (in CRM-M-25483-2025) are ordered to be released on regular bail to the satisfaction of the Trial Court/Duty Magistrate concerned. 10. The present petitions stand disposed of. 11. The pending application(s), if any, shall stand disposed of accordingly. 12.
