By this petition under Section 528 of the BNSS, 2023, the petitioners have prayed for the following relief(s): “(A) It is, therefore prayed that the Hon'ble Court be pleased to quash the F.I.R No. 01/2022, Charge Sheet issued under section 498-A, 506, 406,34 of the IPC and 3 and 4 of Dowry Act and criminal proceeding 1818/22 pending before the JMFC Raipur Dist Raipur(C.G.) (B) That, the honble high court, being pleased, to quash cognizance order dated 4/3/22 passed by JMFC Raipur Dist Raipur (C.G.) in the interest of justice..” 2. At the time of hearing, this Court has observed that the petitioner has filed the present petition without impleading the necessary party in the petition, therefore, we are not inclined to entertain this petition, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh petition. 3. Learned State counsel has no objection. 4. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the 3 aforesaid liberty, as prayed for, subject to depositing a sum of Rs. 1,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.). 5. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner/ State after obtaining the photocopy of the same.
