1. The present petition purportedly in public interest has been filed by the petitioner seeking action against respondent nos. 4 and 5 and investigation of complaint made by the petitioner against the said respondents.
2. Learned Standing Counsel has raised preliminary objection that the petitioner is a resident of Lucknow and all the respondents impleaded are situated at/ residents of Lucknow and, therefore, filing of the petition at Allahabad is essentially mala fide.
3. When learned counsel for the petitioner was confronted with the said aspect, he was unable to give any cogent reason for approaching the Court at Allahabad, instead of the Bench at Lucknow. A lame excuse was indicated that as the matter pertains to Lucknow Jurisdiction, therefore, he has filed the petition at Allahabad being distant from Lucknow.
4. Plea sought to be raised is baseless and cannot be countenanced.
5. Admittedly, the cause, if any, has arisen within the territorial jurisdiction of Lucknow Bench. The petition is therefore, dismissed for the lack of territorial jurisdiction.
