This application has been filed by the applicant for quashing the summoning order dated 13.08.2024 in N.C.R. No. 314 of 2021 (State Vs. Shiv Pratap Singh @ Guddu Singh) under Sections 323, 504, 427 I.P.C., Police Station Bidhnu, District Kanpur Nagar, pending in the court of Additional Chief Judicial Magistrate, Kanpur Nagar. 3. After some arguments, learned counsel for the applicant prays that the applicant may be permitted to move appropriate application before the Court concerned as provided under Section 250(2) of the BNSS. 4. This prayer has not been opposed by the learned A.G.A. 5. Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court within 15 days from today and move an application claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously. 6. For a period of 30 days, no coercive action will be taken against the applicant. 7. With the above observations, the application stands disposed of.
