Heard the parties.
The petitioners have been made accused in connection with Latehar P.S. Case No. 149 of 2024, corresponding to G.R. Case No.621 of 2024, for the offence under Section 103 & 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Latehar.
Petitioner No.1 happens to be the son of the deceased Muneshwar Oraon, while petitioner No.2 happens to be his wife. It is alleged that the deceased was having illicit relationship with one Babita Devi. Both the petitioners used to oppose his relationship with her. On the date of occurrence, the deceased in an inebriated condition came to his house and told them that he is coming from the house of Babita Devi. He also started abusing and assaulting the petitioners. The petitioners, on being agitated, assaulted him with lathi, due to which, he succumbed to his injuries.
Learned counsel for the petitioners submitted that the occurrence was not premediated and has taken place at the spur of moment.
In view of the aforesaid fact, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Latehar P.S. Case No. 149 of 2024, corresponding to G.R. Case No.621 of 2024.
