The present petition has been filed by the Petitioner Society, inter alia, challenging order dated 11th August, 2025 passed by the Registrar of Cooperative Societies (hereinafter “RCS”), by which the deemed approval granted by the Petitioner Society to expulsion of Respondent No. 2 - Mr. R.P. Singh has not been accepted. 3. The letter dated 11th August, 2025 passed by the RCS reads as under:- This is a digitally signed order. The brief facts of the case are that the Respondent No. 2 was an office bearer in the Petitioner Society during the period April 2012 to March 2022. It is the case of the Petitioner Society that the Respondent No. 2 had misused his position and certain allegations were raised against him which led to the Petitioner Society resolving on 11th January, 2025 to expel the Respondent No. 2 from the membership of the Petitioner Society. 5. Thereafter, a reference was made to the RCS under Section 86 (2) of the Delhi Cooperative Societies Act, 2003 for approval of Respondent No. 2’s This is a digitally signed order. It is stated that the said reference was to be decided within 180 days by the RCS as per Section 86(3) of the DCS Act, which expired on 22nd July, 2025. Accordingly, since no decision was taken by the RCS within the said period, the Petitioner Society issued the letter of deemed approval of expulsion on 24th July, 2025 to the Respondent No. 2. 6. It is stated that subsequent to the above letter, the RCS initiated proceedings under Section 86 of the DCS Act and issued the impugned order dated 11th August, 2025. This was challenged by the Petitioner Society before the Financial Commissioner which was disposed of vide order dated 11th September, 2025 remanding the matter back to RCS. 7. The Petitioner Society aggrieved by the said order of the RCS dated 11th August, 2025 and order of Financial Commissioner dated 11th September, 2025, has filed the present petition. 8. Subsequent to the present writ petition being filed, the Respondent No. 2 - Mr. R. P. Singh had challenged the deemed approval of expulsion passed by the Petitioner Society before the Delhi Cooperative Tribunal. 9. Since the main order of the Petitioner Society by which the expulsion was approved, is itself now under challenge before the DCT and both the member - Mr. R.P. Singh and the Petitioner Society are contesting the matter before the DCT, it is directed that the order of the RCS dated 11th August, 2025 and the Financial Commissioner’s order dated 11th September, 2025 are set aside. 10. The DCT shall decide the issue of deemed expulsion of Mr. R. P. Singh on its own merits after hearing both the parties. This is a digitally signed order.
