1. This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner. 2. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent- Corporation. 3. The learned counsel for the petitioner submits that the 6th respondent entrusted the works to the petitioner under different agreements. The details of the work are, (i) construction of open CC drains from E.Pole No.PB-8/3 near service road (NH-44) to E.Pole, No.PB-8/20 at Sapthagiri Colony in Ward No.29, vide agreement No.147/2023-24, (ii) laying of CC road near H.No.74-35 to 74-29 (KuravaGari) and ward office front side 84 Sachivalayam ward No.33 Kallur, vide agreement No.91/2023-24, (iii) construction of internal CC drains from H.No.77/1361-A-3-2-9 to 77/1361/C/4/B in Farooq Nagar in Ward No.35, vide agreement No.93/2023-24, (iv) laying of 110 mm dia UPVC pipeline at H.No.57/64-e4 to 57/64-h, Yelukuri gate & rangareddy gate in 2nd Sachivalayam area 1st ward, vide agreement No.89/2023-24. these works are sanctioned under gadapa gadapaku mana prabhutwam scheme. 4. The learned counsel further submits that the petitioner duly executed the work to the satisfaction of the competent authorities of the 6th respondent.
It is further submitted that after execution of the works, the competent authority recorded the progress of the work in M Books and thereafter the petitioner has submitted respective final bills aggregating to a sum of Rs.26,41,531/- and the same was approved by the authorities of the 6th respondent, but so far no payment has been made to the petitioner. 5. The learned standing counsel for the 6th respondent, on oral instructions, submits that the works undertaken by the petitioner was completed to the satisfaction of the 6th respondent and the payment would be made in due course. 6. Considering the submissions that the work completed by the petitioner is not in dispute, there shall be a direction to respondents 2, 3 and 6 to verify and release the payment due payable to the petitioner within a period of six weeks. 7. With the above direction, the writ petition is disposed of. No costs. 8. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
