The Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is filed on behalf of the petitioners/accused Nos.1 & 2 seeking regular bail in Crime No.39 of 2024 of Gangaraju Police Station, AIIuri Sitharama RaJ-u District. ``----= - `- fEH \ 2. A case has been registered against the petitl'oners herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Actl 1985. 3. Case of the prosecution is that, on 20.07.2024, at about 14.00 hours, the Sub-Inspector of Police, G.Madugula Police Station, received credible information about illegal possession and transportation of Ganja. On his instructions, ASI and his staff reached MRO Office Junction and started conducting vehicle check. At about 16.30 hours, on seeing police, accused vehicle was stopped 50 meters away from the checking point. Immediately police chased and apprehended them. Police found 169 Kgs of Ganja and seized the same from the possession of the accused. 4. Heard both sides. 5. A perusal of the material goes to show that, the petitioners were arrested on 26.o7.2024 and have been jn judicial custody since then. They have been languishing in ja'll for more than six months. Learned Assistant Public Prosecutor submits that the investigation is still in progress and no charge-sheet is filed. However, the statutory period of 180 days has expired. _ 1O ¢#,. 6. ln view Of the aforesaid facts and C'lrCumStanCeS, this Court is // inclined to grant ba" to the petit'loners/ accused Nos.1 & 2 herein, On the following cond'ltions. (i) The petitioners/ accused Nos.1 & 2 herein Shall be released on their executing a personal bond for Rs.10,00or (Rupees ten thousand Only) each With two Sureties for a like sum each to the satisfaction of the learned I Additional District & Sessions Judge-Gum-Special Judge for trial of offences under the NDPS Act, at Visakhapatnam. (ii) on release, the Petitioners/accused Nos. 1 a 2 shall appear before the station House Officer concerned Once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of the Charge-Sheet. 7.
