On the contrary, the learned Government Pleader for the respondents submits that there is no interference by the respondents with the petitioners’ peaceful possession and enjoyment of the subject property. It is asserted that the petitioners are, in fact, attempting to encroach upon neighbouring lands, over which house site pattas have been issued to certain landholders under Patta No.7.
It is further stated that the petitioners are trying to enter upon those patta lands, and the respondent authorities have merely cautioned them not to encroach upon the said properties. 5. Considering the submissions of both learned counsel and on perusal of the material available on record, this Court is of the considered view that the Writ Petition can be disposed of by directing the respondent authorities not to interfere with the peaceful possession and enjoyment of the subject property of the petitioners. However, if the respondents intend to take any action affecting the petitioners’ possession, they shall strictly follow due process of law. 6. Accordingly, the writ petition is disposed of. No costs. ::4:: As a sequel, interlocutory applications if any pending, shall stand closed. ________________________ JUSTICE D. RAMESH Dt:12.11.2025 klk
