THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO. 948 OF 2025 ORDER: This Criminal Petition, under sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A8, seeking regular bail, in Crime No.344/2024 of Pattabhipuram Police Station. 2. A case has been regl'stered agal'nst the petitioner herein and others for the offence punI-Shable under Sections 20(b)(ii)(B) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. The case of the prosecution in brief is that: Al to A4 and Juvenile in conflict wl-th law no.1 prior to ll.ll.2024 went to Araku where Al and Juvenile in conflict with law no.1 purchased 8 kgs of ganja from A7 and A8. Al to A4 and CCL-1 smoked some ganja and safeguarded the remal-nI'ng ganja in bushes in Srinivasaraopet, Guntur. On ll.ll.2024 mornl'ng Al to A6 and COL-1 gathered near the lake in Netaji Nagar, Guntur; CCL-1 sold small packets of ganja weighing about 25 grams to A9, A10, A12, A13, A15 and A25 for Rs.200/-each and earned some money. ln turn', all of them sold the same to others. On information, the Inspector of police, in the presence of mediators and Gazetted Officer, took custody of Al to A6 and CCL-I and seized 7.195 c=-s=r~ 2 kgs of ganja. The contraband along with other material was seized under cover of a medl-ators report and a case has been registered against the accused. petitioner/A8 surrendered himself before the polI'Ce COnCerned on 04.12.2024. 4. Heard. perusedtherecord. 5. A perusal of the material on record goes to show that the police allegedly seized 7.195 Kgs of Ganja from the possession of accused, whI'Ch iS a non-commercI'al quantl-ty. The petl'tI-Oner/A8 was arrested on o4.12.2024 on his surrender and sI'nCe then he is jn judI'CI-al remand, 6. In vI-eW Of the aforesaid facts and circumstances of the case, this court is inclined to grant bail to the petitioner/A8 on the following conditions. I') The petitI'Oner/A8 shall be released on ba" on his executI'ng personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two suretI'eS Of the like sum each to the satisfaction of the learned special JudicI-aI First Class Magistrate (proh. & Excl'se), Guntur; ii) on release, the petitl'oner sha" appear before the station House officer concerned, once in a week l'.e. on every saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
