JUSTICE PARTHIVJYOTI SAIKIA ORDER 09.01.2025 Heard Mr. H R A Choudhury, learned senior counsel for the petitioner assisted by Mr. A. Islam, Advocate and Mr. D P Goswami, learned Additional Public Prosecutor, Assam. By this application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Ibrahim Jaddar, who was arrested in connection with Gauripur P.S. Case No. 338/2024. A 37 (thirty seven) years old married lady had lodged an FIR before Police alleging that the present petitioner was putting pressure upon her to have a relationship with him. She also agreed to that. Without the knowledge of her husband, they had committed physical relationship. The Page No.# 2/2 petitioner allegedly made some videos also. Lastly, the petitioner threatened the lady that he will upload those videos in social media. Further, it is alleged in the FIR that the petitioner took an amount of Rs.5 Lakh, gold ornaments and a blank cheque from the informant. In spite of that, the informant did not inform her husband. Mr. Goswami has submitted that for consideration of the bail prayer of the petitioner, perusal of the case will be necessary. On the other hand, Mr. Choudhury has submitted that under the given circumstances of the case, the petitioner no longer deserves to be detained in custody as he has completed 79 days in judicial custody. I have considered the submissions made by the learned counsel of both sides. This court is of the opinion that under the given circumstances of the case, the prayer made by Mr. Choudhury deserves to be accepted. Therefore, the prayer for bail is allowed. Accordingly, it is directed that the petitioner Ibrahim Jaddar, who was arrested in connection with Gauripur P.S. Case No. 338/2024, shall be released on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhubri. The bail application is disposed of.
