GP FOR REVENUE The Court made the following: 3 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a writ, direction, order or orders, more particularly one in the nature of a Writ of Mandamus, declaring the inaction of respondent Nos.4 to 6 in considering the petitioner’s representation dated 28.10.2025 and in mutating the petitioner’s name in the revenue records in respect of land in Sy.No.150-1A, admeasuring Ac.0.46 cents, situated at Trilochanapuram Village, Ibrahimpatnam Mandal, NTR District, by issuing patta and Ryotwari Passbook in favour of the petitioner, as illegal, arbitrary, unlawful, violative of the principles of natural justice, violative of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, and violative of Articles 14, 19, 21 and 300-A of the Constitution of India; and consequently to direct respondent Nos.4 to 6 to consider the petitioner’s representation dated 28.10.2025 and mutate his name in the revenue records in respect of the said land by issuing patta and Ryotwari Passbook in his favour, and pass such other or appropriate orders…” 2. The subject land was originally assigned in favour of the petitioner’s father. On a complaint submitted by the petitioner, the 4th respondent passed resumption proceedings dated 13.03.2025 under the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, directing the 5th respondent to take possession of the land in R.S.No.150-1A, admeasuring Ac.0.46 cents, from one Chinnapareddy Koti Reddy, and to 4 hand over the same to the original assignee (the petitioner’s father) or his legal representatives. 3. Subsequently, the petitioner’s father passed away on 16.03.2009. The petitioner thereafter filed an application under the RTI Act before the 4th respondent seeking details relating to the said land. In response, the 4th respondent issued an endorsement dated 22.10.2025 stating that the subject land had been assigned in favour of the petitioner’s father; that Adangal/1-B records were made online from the year 2011 onwards; and also furnished a copy of the resumption order as sought under the provisions of the RTI Act, 2005. 4. Thereafter, the petitioner submitted a representation dated 28.10.2025 seeking mutation of his name in the revenue records as the legal heir of his deceased father. Despite receipt of the said representation, the respondents have neither considered nor disposed of the same. Hence, the present writ petition is filed. 5. Considering the submissions and on perusal of the material available on record, this Court is not inclined to go into the merits of the case. Based on the record placed before this Court, the 4th respondent is directed to consider the petitioner’s representation and pass appropriate orders strictly in accordance with law and based on the available records, after providing sufficient opportunity to all concerned, if necessary. The entire exercise 5 shall be completed within a period of two (2) months from the date of receipt of a copy of this order. 6. With the above directions, the writ petition is disposed of.
