Learned counsel appearing on behalf of the appellant submits that the impugned order suffers from error of law on the face of record. The plaintiff’s husband was not a new entrant. He was working as a work charged employee and grant of pensionary benefits.

This Court has heard the learned counsel for the parties and perused the material on record. Admittedly, the plaintiff’s husband worked as a work charged employee since November 11, 1986 2019 (O&M)

One of the exceptions to the said rule is cases relating to a continuing wrong. Where a service related claim is based on a relief can be granted even if there is a long delay in seeking remedy, with reference to the date on which continuing wrong commenced, if such continuing wrong creates a continuing source of injury. exception to the exception.
