The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to accept his technical resignation. 2. Mr. H.S. Saini, Advocate for the petitioner submits that petitioner pursuant to advertisements dated 08.09.2016 and 01.09.2016 applied for the post of Intelligence Officer (Sub-Inspector) and Intelligence Officer (Constable). He was selected as Intelligence Officer (Constable). He joined as Intelligence Officer (Constable) on 01.01.2017. He was also eligible for the post of Intelligence Officer (Sub-Inspector), however, after a long litigation, he was permitted to join as Intelligence Officer (Sub-Inspector). He joined as Intelligence Officer (Sub-Inspector) on 12.05.2023. He requested the respondent to accept his technical resignation because he was working with same authority as Intelligence Officer (Constable). In view of Rule 3.12 (A) and 3.15 of Punjab Civil Services Rules, 1970, Volume-I, Part-I as well as instructions dated Asgar Ali 2025.05.08 16:59 I attest to the accuracy and integrity of this document CWP-13065-2025 2 15.11.2000, 15.01.2015, 07.11.2017 & 25.09.2017, the respondent is bound to accept his technical resignation. 3. Notice of motion. 4. Mr. Aman Dhir, DAG, Punjab who on advance notice is present in Court, accepts notice on behalf of the respondents. 5. With consent of learned counsel for the parties, the case is taken up for final disposal. 6. Mr. Aman Dhir, DAG, Punjab submits that despite impugned order dated 11.12.2024 (Annexure P-12), the Competent Authority is actively considering claim of the petitioner and an appropriate order would be passed within four weeks from today. 7. Mr. H.S. Saini, Advocate agrees with aforesaid arrangement. 8. In the wake of statement of both sides, the present petition stands disposed of. The petitioner would be at liberty to file fresh petition, if respondent reiterates its order dated 11.12.2024.
