...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus by directing Respondents No.1 and 2 to restrain the action of the Respond4nt No.3 in calling the Petitioner to police station of Chittoor I Town and askipg for the business details and the day to day business issues and stopping of the regular business activities of Tirumala Granites and pressurizing the Petitioner to have a forceful settlement with Respondent No.4 and 5 across the table, as illegal, arbitrary, unjust, capricious, whimsical and violation of Article 14,21 and 300-A of the Constitution of India, in the interest of Justice and Equity.
IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents No.1 & 2 to restrain the Respondent No.3 in harassing the Petitioner and calling the Petitioner to Police station and asking for the day to day business issues of the petitioner firm Tirumala Granites and direct the Respondent No.3 not to interfere with the business activities of the Tirumala Granites without following the due process of Law, in the interest of Justice and Equity. The Court made the following:
ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“.... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus by directing Respondents No.1 and 2 to restrain the action of the Respondent No.3 in calling the Petitioner to police station of Chittoor I Town and asking for the business details and the day to day business issues and stopping of the regular business activities of Tirumala Granites and pressurizing the Petitioner to have a forceful settlement with Respondent No.4 and 5 across the table, as illegal, arbitrary, unjust, capricious, whimsical and violation of Article 14,21 and 300-A of the Constitution of India, in the interest of Justice and Equity. ...”
At the time of hearing, learned Assistant Government Pleader for Home appearing for respondent State placed on record the written instructions and would submit that respondent Police called the Petitioner to the Police Station during the course of investigation of the subject crime and respondent Police never interfered in the day to day activities of the Petitioner and would submit that appropriate orders may be passed by disposing of this Writ Petition.
Learned counsel for the Petitioner would submit that recording the said submission, the Court may pass appropriate orders.
In the light of the submissions made, this Writ Petition is disposed of. Respondent Police are directed to follow due process of law with regard to the subject crime which is registered against the Petitioner. No order as to costs.
Pending applications, if any, shall stand closed.
