JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 24-07-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 137(2)/140(1) of the BNS and Section ¾ of the D.P. Act. 3. It is a case of Dowry Death. Daughter of the informant was married to co-accused Shushil Kumar five year ago. After some time of marriage, all the accused persons started Patna High Court CR. MISC. No.44174 of 2025(2) dt.24-07-2025 2/3 demanding dowry. Due to non-fulfillment of demand of dowry, they committed torture and killed the daughter of informant. 4. Petitioner No. 1 is father-in-law, petitioner No. 2 is mother-in-law, petitioners No. 3 and 4 are brothers-in-law, petitioner No. 5 is Nanad and petitioner No. 6 is Jethani of the deceased. They are separate in mess and property and have got no concern with the affairs of couple. As a matter of fact, the victim was in love affairs with some other persons and as such she eloped with him. Petitioners have never demanded any dowry or committed torture to the daughter of the informant. General and omnibus allegations have been levelled against these petitioners and no specific role has been attributed to these petitioners. The thrust of the allegation is against husband who is already in custody since 25.04.2025. Petitioners claim clean antecedent. 5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail. 6. Considering the aforesaid facts & circumstances, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Patna High Court CR. MISC. No.44174 of 2025(2) dt.24-07-2025 3/3 learned Chief Judicial Magistrate, Begusarai, in connection with Balia P.S.
