Learned AGA takes notice for all the respondents.
2. Learned Senior counsel, Sri. Sathish Doddamani appearing for the petitioner submits that the petitioner gave a representation to respondent No.3-Tahsildar, Chitradurga Taluk on 15.06.2024 seeking certain correction in the computerized RTC towards the extent of land. It is contended that the petitioner, whose name is entered in the RTC in Sy.No.42/1 at Annehal Village, Kasaba Hobli, Chitradurga Taluk and District is entitled for 3 acres 38 guntas and in Sy.No.42/2 he is entitled for 2 acres 12 guntas. However, in the RTC pertaining to

Sy.No.42/1, what is shown is 2 acres 33 guntas instead of 3 acres 38 guntas. Similarly, in respect of Sy.No.42/2 what is shown in the RTC is 1 acre 23 guntas instead of 2 acres 12 guntas. However, the Tahsildar has issued the impugned endorsement stating that he has no power to rectify the mistake. Learned Senior counsel submits while drawing attention of this Court to Section 129(4) and (5) of the Karnataka Land Revenue Act, 1964 (for short “the KLR Act”) that while making such entry, if objections are raised then it will be the duty of the Tahsildar to enter such objection and then issue notice and conduct an enquiry. The Tahsildar cannot deny causing an enquiry.
3. The provisions contained in Section 136(2) of the KLR Act, would enable a person, who is affected by an
order already passed by the Tahsildar under section 129(4) of Act to approach the Assistant Commissioner raising a challenge to such an order.
4. However, learned Additional Government Advocate submits that the provisions contained in Section

129 of the KLR Act will apply during the course of entry. However, the situation in the present case is not so. The entries have already been made and what the petitioner is seeking is correction of the same. Therefore, the endorsement issued by the Tahsildar cannot be faulted. The Tahsildar has only stated that once the entry had been made, he has no power to correct it and therefore, he has
directed the petitioner to approach the Appellate Authority.
5. There is substance in the submission made by the learned Additional Government Advocate. Therefore, this Court is of the considered opinion that the impugned endorsement issued by the Tahsildar cannot be faulted.
6. The Writ Petition is disposed of reserving liberty to the petitioner to approach the Assistant Commissioner.
