The petitioner who is a complainant has preferred the present petition with the prayer to quash the order dated 28.03.2025 passed by the respondent No.2/District Magistrate, Kasganj. 2. Today when the matter is taken up, a preliminary objection has been raised by learned Standing Counsel that the petitioner is a complaint and once a decision has been taken by the respondent No.2 after considering all aspect of the matter, there is no occasion the petitioner to challenge the same before this Court under Article 226 of the Constitution of India. It is further argued that nothing has been stated in the entire writ petition nor any argument has been raised that what prejudice has been caused to the petitioner by the aforesaid order. 3. At this state, a prayer has been made by learned counsel for the petitioner to dismiss the present petition as withdrawn. 4. Learned counsel for the respondents have no objection. 5. Accordingly, the present petition is dismissed as withdrawn. 6. It is made clear that no liberty is granted to the petitioner to file fresh petition for the same cause of action.
