GP FOR HOME (AP) 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 12176/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent Nos.3 to 5 in interfering with petitioners life and liberty by summoning him to the police station and harassing him to settle the civil disputes with the respondent Nos.6 and 7 on their behest is illegal, arbitrary exercise of power, wholly unjust and the same is violative of principles of Natural Justice and also violative of Article 14, 19 and 21 of the Constitution of India, consequently direct the respondents not to interfere with petitioner's life and liberty.…” 2. None represented on behalf of the petitioner. The grievance of the petitioner is that the respondent-police are calling the petitioner to the police station and harassing him to settle the civil disputes between the petitioner and the unofficial respondents. 3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, by way of counter affidavit, would submit that basing on the complaint made by the 6th respondent, a case in Cr.No.102 of 2024 was registered for the offences punishable under Sections 355, 506 r/w 34 of IPC against the petitioner and another. He would further submit that prima facie, case is made out against the petitioner. Except registration of the above crime, the police never interfered in the civil disputes between the petitioner and the unofficial respondents. 4 4. Recording the same, this Writ Petition is disposed of. However, the respondent-police are directed to follow due process of law regarding the crime which has been registered against the petitioner.
