By the present writ petition, the petitioner, who is a retired Assistant Conservator of Forest, is seeking a direction towards the respondent authorities to comply with the order dated SOURABH BHILWAR Digitally signed by SOURABH BHILWAR Date: 2025.05.08 10:15:06 +0530 2 / 3 24/11/2023 passed by the Govt. of Chhattisgarh by which it has been directed that the recovery of Rs.64,411/- was wrongly recovered from the petitioner and the same be refunded back to him and it was also directed to revise the pay scale and pension case of the petitioner. 2. Learned counsel for the petitioner submits that earlier the writ petition was filed by the petitioner bearing WPS No.58/2015 by the petitioner which was disposed of vide order dated 25/04/2023. By the said writ petition, the petitioner was questioning the order dated 14/11/2014 which was passed by the Secretary, Government of Chhattisgarh, Forest Department. The said writ petition was allowed by setting aside the order dated 14/11/2014 and 13/10/2011 by remitting back the matter to disciplinary authority i.e. Government of Chhattisgarh to pass a well reasoned order thereafter. In compliance to the order passed by this Court, the State Government vide its order dated 24/11/2023 passed an order to refund the recovery made from the petitioner and to revise the pay scale and pension case of the petitioner but till date, the respondents have not complied with their own order. He further submits that the petitioner submitted various representations lastly submitted on 25/09/2024 to the concerned authorities and reminded them on various occasions, however, the same are not being considered till date. 3. Learned counsel appearing for the State submits that the petitioner has submitted several representations to the respondent authorities and if the said representations are still 3 / 3 pending, the same shall be considered in accordance with law as well as the order dated 24/11/2023 passed by the State Govt., within the stipulated time. 4. I have heard learned counsel for the parties and perused the documents. 5. From perusal of the pleadings, it appears that pursuance to the order dated 25/04/2023 passed by this Court, the State Government has taken a decision on 24/11/2023 to refund the amount of Rs.64,441/- which has wrongly been recovered from the petitioner and also directed to revise the pay as well as the pension case of the petitioner. 6. In view of the submissions made by the parties and considering the fact that the petitioner has submitted several representations to the respondent authorities, the writ petition is disposed of with a direction to respondent No.1 to decide the pending representation submitted by the petitioner in accordance with law and the order dated 24/11/2023 of the State Government, within a period of 45 days from the date of receipt of a copy of this order. 7.
