1. By the present Writ Petition, the Petitioner is seeking a direction towards the respondents’ authority to release the pension as well as retiral dues of the petitioner along with interest @ 12 percent. 2. At the very outset, learned counsel for the respondent submits that the retiral dues of the petitioner has already been transferred to the account of the petitioner. This fact has not been disputed by the counsel for the petitioner. 3. As far as quantum of retiral dues with interest is concerned, learned counsel for the petitioner referring to circular dated 08/03/1994, would submit that if the amount of retiral dues is paid at a belated stage, then the employee is entitled to get 12% interest on the same. 4. From the above submission, it is quite vivid that the retiral dues of the petitioner has already been transferred to the account of the petitioner.
If the petitioner is aggrieved or claiming interest on the retiral dues/gratuity, he is free to approach before the authority by submitting the representation. 5. Accordingly, the Writ Petition is disposed of. However, it is directed that in case of petitioner approaching before respondent No.5 by submitting a representation claiming the interest on retiral dues and gratuity amount,
3 the same shall be considered and decided in accordance with law within a period of 50 days from the date of receipt of copy of this order. Sd/- (BIBHU DATTA GURU) JUDGE Rahul
