Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 B.N.S.S. seeking transfer of Case Suit No. 673 of 2022, titled Maya Rani Vs. Naresh Chandra, pending before the Additional Principal Judge, Family Court, Court No.2, Meerut to the court of competent jurisdiction at Bulandshahar. Learned counsel submits that the applicant is nearly 60 years old, who is suffering from various ailments, therefore, it is difficult for him to contest the maintenance case filed by opposite party no.2 under Section 125 Cr.P.C., which is pending at Meerut. He prays that the case be transferred to Bulandshahar. Considering the nature of the case as well as the distance between two towns, which is nearly 75 kilometers, the sole ground of convenience of one of the parties is not sufficient for transfer of the case.
