JUSTICE ANUP JAIRAM BHAMBHANI O R D E R % 17.07.2026 Ms. Tanya Verma, learned counsel for the plaintiff submits, that parties have settled the matter through Mediation vide Settlement Agreement dated 15.12.2025. She submits that the terms of settlement be taken on record and the suit be decreed in those terms. 2. Counsel for the defendant concurs with the submission, a copy of Settlement Agreement dated 15.12.2025 is appended to the plaint. 3. Upon reading the terms of settlement the court is satisfied that the parties have resolved their disputes by a lawful agreement and there is no impediment to decreeing the suit in terms of the settlement. 4. Accordingly, the suit is decreed in the terms contained in the settlement agreement. 5. The registry is directed to draw up a decree sheet. Let a copy of the settlement agreement be annexed to the decree. This is a digitally signed order. 6. Counsel for the defendant submits, that they have carried-out the process of disposal of the infringing goods in accordance with the directions contained in order dated 06.02.2026 in arrangement with an e-waste management company called M/s. GWS Waste Solution Pvt. Ltd.
7. Accordingly, suit is disposed-of. 8. Pending applications, if any, disposed-of. 9. Ms. Verma seeks refund of the court fee. The matter is at a preliminary stage; pleadings are not complete. 10. In view of the Court Fees (Delhi Amendment) Act, 2026 which came into effect on 06.03.2026, section 16-A of the Court Fees Act, 1870 (as was applicable to Delhi) has been omitted. Accordingly, section 16 of the Court-fees Act, 1870 would be applicable, which allows for refund of the entire amount of court fee affixed on the plaint. 11.
Accordingly, the Registry is directed to draw-up the requisite certificate in favour of the plaintiff for refund of the entire court fee affixed on the plaint within 10 days.
