GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 35365/2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the high handed action of the Respondents more particularly the action of the 4th respondent against the petitioners by summoning the petitioners to the police station on daily basis in interfering into the civil dispute in connection with the property situated in to an extent of Ac.0.30 cents of lands situated at Musunuru Grama Panchayat limits, Kavali Mandal and Municipality SPSR Nellore as illegal, arbitrary, unconstitutional and violative of Article 14,19 and 21 of Constitution of India and consequently direct the respondent No.4 viz., Station House Officer, Kavali rural Police Station not to interfere into the civil dispute in connection with the property situated in to an extent of Ac.0.30 cents in Sy.No.595/1 cents of lands situated at Musunuru Grama Panchayat limits, Kavali Mandal and Municipality SPSR Nellore.…” 2. Heard Smt.K.Sumathi, learned counsel for the petitioners and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned counsel for the petitioners would submit that the respondent No.4 is interfering in the civil disputes between the petitioners and the unofficial respondent and summoning the petitioner to the police station without there being any crime registered against them. 4. Learned Assistant Government Pleader for Home, on instructions, would submit that on the complaint made by the 5th respondent, the petitioners 4 were called to the police station for preliminary enquiry only and no crime has been registered against the petitioners. He would further submit that they are not interfering in the civil disputes between the parties. 5. Recording the same, this Writ Petition is disposed of. However, the respondent-police are directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
