Mr. D.S. Mehta and Ms. Nisha Bora, learned counsel for the applicant. 2. Mr. Siddharth Bisht, learned A.G.A. and Mr. Himanshu Sain, learned Brief Holder for the State. 3. This is the second bail application moved on behalf of the applicant seeking bail in relation to FIR dated 20.12.2024, registered as FIR No. 0036 of 2024 at P.S. Thal, District Pithoragarh wherein the applicant has been implicated for the offences punishable under Sections 103, 238 and 3(5) of BNS 2023. 4. First bail application was dismissed as withdrawn on 28.03.2025. 5. Yesterday, this Bail application was listed and the counsel for the applicant informed this Court that the applicant’s father died on 27.04.2025, and, therefore, his presence is required for performing the other rituals. The State was directed to verify this aspect and, today, Mr. Siddharth Bisht, learned A.G.A., on instructions, informed this Court that the applicant’s father died on 27.04.2025. 6. Learned counsel for the applicant submits that the instant bail application may be converted into short term bail application. 7. The present applicant is facing the trial in respect of the offences punishable under Sections 103, 238 read with Section 3(f) of BNS 2023. The applicant is languishing in jail since 09.05.2024 and charge sheet has also been filed. 8. Since, the counsel for the applicant 2025:UHC:3280 submits that present second bail application be converted into short term bail application on the ground that applicant’s father died and this fact also verified by the State Counsel , the instant second bail application is converted into a short term bail application. 9. Accordingly, the short term bail of the applicant is allowed and the applicant is granted short term bail for a period of 45 days, to be reckoned from the date of his release, on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 10. Needles to say, on completion of 45 days period, to be reckoned from the date of release, the applicant shall surrender before the court concerned failing with the concerned Chief Judicial Magistrate shall issue necessary warrant.
