1. This is an application filed by the plaintiff seeking a direction that the Court refund certificate be issued in the name of the plaintiff’s counsel.
2. He states that it is logistically inconvenient to take steps and complete formalities for accepting the Court fee refund certificate in the name of the plaintiff itself since it is an entity based outside India.
3. He submits that similar orders have been passed in favour of this plaintiff in other proceedings, where matters were compromised.
4. This Court has heard the learned counsel for the parties and takes note of the fact that this indeed is correct that order of refund has been passed, however, this Court is of the view that such a practice should not be encouraged, unless absolutely unavoidable, as it may lead to potential conflict with the ethical practices. This Court is not satisfied with the reasons stated in This is a digitally signed order. the application for seeking refund. Bearing in mind, the fact that the plaintiffs regularly institute suits in the High Court and this issue often arises in their matters, they would be well advised to take steps to open bank accounts in accordance with law for the purpose of payment and/or refund of the court fee.
5. Accordingly, the request is declined. The application is dismissed.
