THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION No.19627 of 2025 O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) The prayer and pleadings of the writ petition show that the 2nd respondent - Commissioner of Police and Additional District Magistrate, NTR District, has passed the impugned order of preventive detention and it was confirmed by the State. But, a reading of the material on record shows that the impugned order of preventive detention was in fact passed by the State itself. Though the 4th respondent, who has passed the impugned order of preventive detention, was subsequently impleaded, the prayer and pleadings were not corrected.
2. In view of the same, learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to the petitioner to file a fresh writ petition with correct pleadings.
3. Permission is accorded.
4. Accordingly, the writ petition is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs.
4
As a sequel, interlocutory applications, if any pending, in this case shall stand closed.
