Hon’ble Shri Justice Arvind Kumar Verma, Judge Order on Board 19/11/2025
1. The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has
2 been arrested in connection with Crime No. 71/2025, registered at Police Station Dongargarh, District- Rajnandgaon (CG) for the offence punishable under Section 103(1) of BNS, 2023. 2. The prosecution story in brief, is that, on 15.02.2025 the present applicant committed murder of his wife due to dispute arose between both of them, when they were sleeping. When the younger brother of the applicant received the information regarding the death of the deceased, he immediately informed the concerned police and thereafter, the concerned police registered the merg and arrested the present applicant. On being interrogated, the applicant confessed that he committed murder of his wife in the self-defense. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant has not killed his wife and there is no eye witness and without any basis, the police has registered the offence against the applicant. The applicant is in jail since 15.02.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case
3 diary. 6. A perusal of the records reveals that on 15.02.2025, Dial 112 staff informed them that a woman had been murdered in her home in village Kalakasa, and her body was lying inside. Upon receiving the information, senior officers were informed and the accompanying staff, along with an investigation team, reached the scene of the incident in village Kalakasa. The complainant, Ajay Bagga, filed a case intimation stating that the houses of four brothers in village Kalakasa are adjacent to each other.
His brothers, Amarjeet and Indrajeet Bagga, wake up every morning between 4.30 and 5.00 am, but on 15.02.2025, they had not woken up until approximately 6.30 am. The door was locked from inside. His elder brother, Santosh Bagga, knocked the door to wake them up, but they did not open the door. Then his brother Indrajit Bagga (present applicant) opened the door and saw that his face was covered with blood and there were bite marks on his hands and feet. Before he could say anything, Indrajit Bagga said,
"I killed your sister-in-law with a brick" and went inside. He then followed him into the room, where he saw his sister-in-law lying face down on the bed, with injuries to her face, nose, mouth, and head, and was dead. He then called his elder brother Ramesh and sister-in-law Dimple and told them to go and check. After the entire family arrived, they found his sister-in-law Amarjeet dead. His brother Indrajit Bagga went to sleep on the bed. A piece of brick and a knife, stained with blood, were lying on the floor
4 beside the bed. During the investigation, brick, knife, plain cotton and blood sample lying on the ground were taken from the spot of incident and seized in front of witnesses. 7. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Indrajeet Bagga involved in Crime No. 71/2025 under Section 103(1) of BNS, 2023 at Police Station- Dongargarh, District- Rajnandgaon, Chhattisgarh, is rejected. 8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
