The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue an appropriate Writ, order or direction one in the nature of Writ of MANDAMUS declaring the inaction of the Respondents in considering the application of the Petitioner under Sec.5-A of A.P Rights in Land and Pattadar Passbooks Act, 1971 as arbitrary, illegal and capricious and violative of the provisions of Act 26 of 1971 and consequently direct the Respondents to consider and dispose of the application of the Petitioner forthwith and to pass such….”
2. Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for the respondents.
3. The learned counsel for the petitioner submits that the petitioner filed an application to the respondent authorities dated 28.06.2024 and 26.05.2025 seeking to the 3rd respondent to regularize the possession of the land under section 5-A of the act, 26 of 1971.
4. On the other hand, the learned Government Pleader for Revenue, appearing for the respondents, submits that if the petitioner submits a fresh application/representation, the respondent authorities will consider the same and pass appropriate orders in accordance with law.
5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing
for the respondents, and upon perusal of the material available on record, this Court is of the considered opinion that the present writ petition can be
disposed of by directing the petitioner to submit a fresh online application, within a period of two (02) weeks from the date of receipt of a copy of this
order. Upon receipt of such application/representation, the respondent authorities shall consider the same and pass appropriate orders, in accordance with law, after issuing notice to all concerned parties, within a period of two (02) months thereafter.
6. With the above direction the writ petition is disposed of. No order as to costs.
