This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue writ order or direction more particularly one in the nature of Writ of Mandamus to declare action of the respondents 2 to 4 in not mutating the name of the petitioner in the revenue records and not hand over the land admeasuring Ac.2-15 cents in SR.No.104/3 situated at kondangi village, Kalidindi Mandal, Eluru District in terms of No.RC B 6/5189 LD/70 proceedings of the 4th respondent, dated 05.06.1961. 2. Heard Sri B.V.Ram Naresh Kumar, learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. 3. As per the averments made in the writ petition, the petitioner submitted a representation dated 25.03.2025 to the 2nd respondent requesting to mutate the name of the petitioner in the revenue records and to hand over the subject property, but the respondents failed to consider the said request. Hence, the present writ petition. 4 DR,J W.P.No.30697/2025
4. On earlier occasion, the petitioner filed writ petition before this Court vide W.P.No.23046 of 2024 and the said writ petition was dismissed as withdrawn by order dated 12.08.2025. 5. Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the petitioner has not made an application in the prescribed Form provided as per the provisions of the ROR Act and if the petitioner made application in such form, the respondent authorities will consider the application and they will pass appropriate orders after issuing notice to the concerned persons. 6.
Considering the submissions made by both the learned counsel, the writ petition is disposed of, at the stage of admission with the consent of both parties, giving liberty to the petitioner to file an application in Form-6A through online within a period of two weeks from the date of receipt of a copy of this
order. On such filing, the respondents concerned shall consider the same as per the provisions of ROR Act, after issuing notice to the concerned persons, and pass appropriate orders within six (06) weeks thereafter. There shall be no order as to costs.
