JUSTICE RAJESH RAI K) We have perused the judgment passed in RFA No. 2101/2018 c/w RFA No.1617/2018 dated 29.03.2023, wherein the Co-ordinate Bench of this Court has passed the following: "ORDER i. RFA No.1617/2018 is dismissed; ii. RFA No.2101/2018 is allowed; iii. The judgment and decree dated 13.7.2018 passed in OS.No.16/2011 by the II Additional Senior Civil Judge and JMFC, Tumakuru, is modified to the extent of declaring that the Plaintiff is entitled to ½ share in the compensation amount awarded by the KIADB in respect of suit property item Nos.1 to 4 and partition and separate possession of ½ share in the suit property item No.5." 2. On careful perusal of the order passed by this Court, there are no specific directions to the respondents/accused in respect of entitlement of the share in the compensation amount. The order passed in the appeal is an executable order.
