IN THE HIGH COURT AT CALCUTTA [ CIRCUIT BENCH AT PORT BLAIR ] … WPA/3/2025 Smti. Lewani Tirkey @ Leoni Tirkey … Petitioner Vs. The Andaman & Nicobar Administration and Anr. …Respondents Ms. G. Mini … for the Petitioner Ms. Babita Das … for the Respondents January 31, 2025 (M.A.Mobin) Item No.1 1. The present writ petition has been preferred with a prayer for the issuance of a writ of Mandamus, directing Respondent No. 2 to issue a Sketch Map for the land bearing Survey No. 8/P, comprising of an area of 0.5000 hectares, situated in Sippighat Village, under Port Blair Tehsil, District South Andaman. 2. Ms. G. Mini, learned Advocate representing the Petitioner, submits that the petitioner was granted a license to occupy the agricultural land and enjoy it in accordance with the terms and conditions set forth in the instrument of license. The petitioner’s name was duly recorded in the relevant land revenue records. She further submits that to avoid any confusion regarding the demarcation of the said land, the petitioner submitted an application to the concerned Tehsildar, requesting the issuance of a sketch map of the land. However, despite the application being received, no 2 action was taken, which compelled the petitioner to file this writ petition. She prays for a direction upon the Tehsildar to issue the sketch map. 3. Ms. Das, learned Advocate representing the Respondents, submits, upon instructions, that before providing the sketch map as requested by the Petitioner, an inspection of the land in question is required to ascertain the actual physical possession of the Petitioner. 4. Having heard the learned Advocate-on-Record and upon perusal of the materials placed before me, I am of the view that, to avoid any future disputes, it would be appropriate for the Tehsildar to conduct a physical field inspection before issuing the sketch map. 5. Therefore, in view of the above, the writ petition is disposed of, directing the Respondent No. 2 to consider the petitioner’s prayer for the issuance of a sketch map in respect of the subject land, after the completion of the field inspection. The entire process shall be completed within two months from the date hereof. It is made clear that the time frame specified herein is peremptory. 6. With this observation and order this writ petition is, thus, disposed of, however, without any order as to the costs. (Partha Sarathi Chatterjee, J.)
