This anticipatory bail application filed by the petitioner praying for grant of anticipatory bail in terms of under Section 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in connection with Sisai P.S. Case No. 101 of 2023, for the offences punishable under Sections 379 and 461 of the Indian Penal Code, pending in the court of learned Sub- Divisional Judicial Magistrate, Gumla. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The allegation in the FIR is that some unknown persons committed robbery of eatables/rations etc, kept for mid day meals from the government school godown. 5. In the impugned order dated 09.11.2024 passed by the court of Vacation Judge-cum-Exclusive Special Judge cum Addl. Sessions Judge-IV, GUMLA, in A.B.P. NO. 416 of 2024, I find that the learned A.P.P. for the State had stated that police has not arrested anyone and the petitioner should not have any apprehension about his arrest and the same is totally misconceived. 2025:JHHC:17530 2 6. Considering the aforesaid finding of the Trial Court, there is nothing on record to suggest that there is clear apprehension of the petitioner of being arrested. Thus, the petitioner should appear before the concerned Court. 7. This Anticipatory Bail Application is thus disposed of. (ANANDA SEN, J.) Rashmi/ Cp-2
