S S ROY (GA, ASSAM), ADDL. SR. GA, ASSAM,MR. T C CHUTIA,MR. C BARUAH,SC, APSC BEFORE HONOURABLE MR. JUSTICE SUMAN SHYAM ORDER 24.02.2025 Heard Ms. B. Mahanta, learned counsel appearing for the writ petitioners. Also heard Mr. T. C. Chutia, learned Addl. Sr. Govt. Advocate, Assam appearing for the State. Mr. T. J. Mahanta, learned senior counsel assisted by Ms. P. Sarma, learned counsel has appeared for the APSC authorities. The 12 writ petitioners herein have approached this Court by filing this writ petition inter-alia seeking a writ of mandamus directing the respondents to regularise their promotions to the rank of District Fishery Development Officer (DFDO). By the order dated 10.02.2025, this Court had directed the learned Page No.# 4/4 departmental counsel to obtain specific instruction in the matter including the instruction pertaining to the claim of the petitioner No.9 to the effect that leaving aside the petitioner No.9 all other petitioners have, in the meantime, been regularised under Regulation 4(d) of the Assam Public Service Commission (Limitation and Function) Regulation, 1951. Today when the matter is called up, Mr. Chutia, learned Addl. Sr. Govt. Advocate, Assam has produced a copy of the written instruction dated 21.02.2025, which goes to show that not only the other petitioners but the promotion of the petitioner No.9, viz., Sri Atul Hazarika to the rank of District Fishery Development Officer had also received approval of the APSC authorities. If that be so, it is apparent that nothing further survives for adjudication by this Court in the present writ petition. The learned counsel for the writ petitioners has also fairly agreed to the said proposition. In view of the above, by retaining a copy of the written instruction dated 21.02.2025 in the record of this case, the writ petition stands closed. JUDGE Comparing Assistant
