This is a petition for anticipatory bail filed under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 in case FIR No.38 dated 06.03.2025 under Sections 406, 420 of the IPC and Section 13 of the Punjab Travel Professionals Regulation Act, registered at Police Station Kartarpur, District Jalandhar (Rural). 2. The case of the prosecution is that one Kulwinder Singh @ Kinda had accepted money amounting to Rs.20,57,000/- and committed a fraud upon the complainant on the pretext of sending him England, however, he was sent to Russia from where he was subsequently deported. Thereafter, the present petitioner being brother of the main accused had approached the complainant and asked him to deposit Rs.2,12,000/- which was transferred in the name of the main accused Kulwinder Singh @ Kinda. After few days, the petitioner contacted friend of the complainant, namely, Satinder on his mobile phone and said that the visa of the POONAM RATHORE 2025.05.26 17:43 I attest to the accuracy and authenticity of this document High Court Chandigarh CRM-M-24861-2025 -2- complainant had been arranged, however a fake visa was sent to the complainant. 3. Learned counsel for the petitioner submits that the petitioner had neither accepted any money nor he had any direct dealing with the complainant. Counsel for the petitioner further states that he had even published a notice in the newspaper stating that he has no dealings with the main accused. Learned counsel for the petitioner submits that the petitioner is ready to join investigation. 4. Notice of motion. 5. On the asking of the Court Mr.Kamalpreet Bawa, DAG, Punjab accepts notice on behalf of the State. 6. Learned counsel for the State has opposed the submission made by the learned counsel for the petitioner by stating that the petitioner and the main accused are brothers and are in the business of immigration and have accepted the money. Moreover, the petitioner namely Amrik Singh had also contacted the complainant in order to part with an amount of Rs.2,12,000/-. The State counsel further submits that this was just to avoid the liability of fraud committed by the petitioner and his brother. 7. The practice of alluring the innocent persons on the pretext of sending them abroad has become prevalent now a days especially in the State of Punjab. Such persons like the petitioner who are playing frauds do not deserve any sympathy from the Court. The Courts cannot be a silent spectator to such like activities. Keeping in view the serious nature of allegations levelled against the petitioner and the fraud committed by him upon the complainant, the concession of anticipatory bail cannot be granted to the petitioner. 9.
