This petition is filed challenging the undated noticed issued under Section 105 of the Gujarat Panchayat Act, 1993 annexed at Annexure A page 10. The said notice is issued by Nandisar Gram Panchayat, Taluka:Godhra, District: Panchmahal. 2. Heard learned advocate Mr. Kumar Trivedi for the petitioner. Learned advocate submitted that for the property in question which is referred in the notice as revenue survey No.103 and revenue survey No.104/1, a Regular Civil Appeal is pending. The suit preferred by the petitioner against the Gram C/SCA/10514/2025 ORDER DATED: 29/07/2025 Panchayat has been decreed in favour of the Gram Panchayat and against the petitioner. Aggrieved by the said order, Regular Civil Appeal is filed and the same is pending. Learned advocate however, could not submit that any stay has been granted in the civil proceedings pending. 3. However, noticing that no opportunity of hearing is provided to the petitioner, this Court deems it appropriate to grant 15 days time to the petitioner to respond to the notice at Annexure A page 10. If Gram Panchayat deems it appropriate, it is open for them to provide personal hearing to the petitioner. Once the petitioner preferred its reply along with the necessary documents, it is open for the respondents to pass appropriate orders in accordance with law. 4.
