GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS by declaring the action of the Respondent No. 3 and 4 in interfering with the Petitioner's peaceful possession and enjoyment of the agricultural land to an extent of Ac 5-20 cents, situated in Survey No. 289 of Mamudipudi Village, Muthukur Mandal, SPSR Nellore District, further calling to the Respondent No. 3 Police Station as illegal, arbitrary and unconstitutional and consequently direct the Respondent authorities 2 for not to interfere with the petitioners' peaceful possession and enjoyment of the agricultural land to an extent of Ac 5-20 cents, situated in Survey No. 289 of Mamudipudi Village, Muthukur Mandal, SPSR Nellore District.” 2. Heard Sri V.Roopesh Kumar Reddy, learned counsel for the petitioner and Sri Ajay Babu, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the police are interfering in the civil disputes between the parties. 4. Learned Assistant Government Pleader for Home would submit that, on receipt of the complaint made by one Vemula Malleswari, the petitioner was called to the police station for enquiry, and no crime has been registered. The petitioner herein is the daughter-in-law of the said V. Malleswari, and there has been a land dispute between them since 2014, which is purely civil in nature. 5. Recording the said submissions, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
