ORAL ORDER This petition is filed by the sole accused under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in Crime No.254/2022 of Jigani Police Station registered for the offences punishable under Sections 307, 332, 353 of IPC and Section 25 of Arms Act, 1959 pending in SC No.5036/2023 on the file of the learned III Additional District and Sessions Judge, Bengaluru District sitting at Anekal.
2. Heard the learned counsel for petitioner and the learned Additional State Public Prosecutor for respondent/State.

3. The
learned counsel for petitioner would contend that, the alleged incident had taken place when police officials, namely, CW1 to CW5 went to secure the petitioner as he is required in Crime No.300/2022 of Anekal Police Station registered for the offences punishable under Sections 353, 333, 307 read with Section 34 of IPC. In the alleged incident, it is alleged that, the petitioner has made an attempt to commit murder of the police official who came to arrest him, and caused injuries to one police official by assaulting with machete. The petitioner has been granted bail in the said Crime No.300/2022 by order dated 13.06.2024. He is in judicial custody since 02.01.2023, and as charge sheet is filed, he is not required for custodial interrogation. In all ten cases registered against the petitioner, he has been granted bail. With this, he prayed to allow the petition. 4. Per contra, the learned Additional State Public Prosecutor for respondent/State would contend that, the petitioner is having criminal antecedents involved in ten

cases for the offences punishable under Sections 307, 302, 392, 397 etc. The petitioner has also earlier assaulted the police officials when they were discharging their duties, and obstructed them from discharging their duties. The petitioner has used a machete to assault the police, and it has been recovered at his instance and it is found to be blood stained. One police official by name Shankar Siddhapur sustained incised injury on his right palmar surface measuring 1.5 cms. x 0.2 mm. The petitioner is a rowdy sheeter. If he is granted bail, there are chances of the threatening the prosecution witnesses and committing similar offences. With this, she prayed to reject the petition. 5. Having heard the learnt counsel, the Court has perused the charge sheet and other materials placed on record. 6. As per charge sheet, the alleged incident has taken place on 25.12.2022, when CW1 to CW5 police

officials went to secure the petitioner, as he was accused in Crime No.300/2022 registered for the offences punishable under Sections 353, 333, 307 read with Section 34 of IPC.
At that time, this petitioner tried to escape from the officials, and when they chased him, he was holding machete, and he slashed at CWs.1 to 5 and threatened them that, he will kill them if they come to arrest him. At that time, he assaulted CW2/Shankar Siddhapur with the said machete, and caused injuries to his right hand. At that time, CW1 after warning fired in air and thereafter at the petitioner's left leg, and he sustained injury. 7. The petitioner is a rowdy sheeter. He is involved in ten crimes for the offences punishable under Sections 397, 392, 394, 302, 307 of IPC. If he is granted bail, there are chances of again he absconding and committing similar offence. - 6 -

8. Considering the above aspects, the petitioner has not made out any grounds for grant of bail. In the result, the following:
ORDER The petition is dismissed.
