ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…may be pleased to issue writ or direction more particularly one in nature of writ of mandamus declaring the action of the respondent No.3 calling the petitioner to the police station without any reasonable cause and adding the petitioner as accused No.2 in FIR No.110 of 2024 dated 15.03.2024 is against the Article 14 and 21 of the constitution, and principles of Natural Justice and also direct the Respondent No.3 not to harass and arrest the petitioner in above said FIR No.110 of 2014 and quash the same, and pass such other order or orders may deem fit and proper in the circumstances of the case…”
2. None represented to the petitioner.
3. The present writ petition is filed seeking a direction to the respondent police not to call the petitioner to the police station and not to harass him in connection with FIR No.110 of 2024 dated 15.03.2024, wherein the petitioner is shown as Accused No.2.
4. Learned Assistant Government Pleader for Home, on instructions, submits that the investigation in the said crime has already been completed and the charge sheet has been filed before the competent Court, the presence of petitioner before the police is not required.
5. In the light of said submissions, the petition is disposed of, however, police are directed to follow due process of law in the crime which is registered against the petitioner.
Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
