This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ, order or direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of 3rd respondent in not deciding ROR Appeal No. 1702/2014, in respect of the petitioner's petition connected to the issue of his claim for granting Pattadar Passbook, Title Deed and mutation of our names for his land of Ac 50.00 Cents in RS No. 470/1A and 470/1B of Lopudi Village, Musunuru Mandal, Eluru (erstwhile Krishna) District, as illegal, irregular, irrational and amounts to non-discharge of legal obligation conferred on 3rd respondent under the provisions of Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 and rules framed there under and offends Articles 14, 21 and 300A of Constitution of India and consequently direct the 3rd respondent to decide the said Appeal in accordance with law…” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos. 1 to 5. 3. The learned counsel for the petitioner contends that the inaction of the 3rd respondent in adjudicating ROR Appeal No.1702/2014, filed by the petitioner for grant of Pattadar Passbook, Title Deed and for mutation of his name in respect of land admeasuring Ac.50.00 cents in R.S.Nos.470/1A and 470/1B of Lopudi Village, Musunuru Mandal, Eluru (erstwhile Krishna) District, is unlawful and arbitrary, being in violation of the provisions of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 and the Rules framed thereunder. 4. 4. On the other hand, the learned Government Pleader for the respondents, on instructions, submits that the said appeal is pending consideration before the 3rd respondent and that, in view of the pendency of civil disputes and proceedings, the respondent authorities have not decided the appeal. 5. Considering the submissions made by the learned counsel on either side and upon perusal of the material available on record, this Court is of the considered view that the appeal filed by the petitioner pertains only to revenue entries based on the existing records. In view of the above, the writ petition is disposed of, directing the 3rd respondent to consider and dispose of ROR Appeal No.1702/2014 and pass appropriate orders, after issuing notice to all concerned parties, within a period of two (02) months from the date of receipt of a copy of this order.
