Present appeal has been filed against only that part of the judgement and order dated 24.03.2017 passed by learned Additional District & Sessions Judge/Special Judge (E.C. Act), Agra in Sessions Trial No. 11 of 1991 (State of U.P. Vs. Kundan & Ors.), under Section 302 read with Section 34 IPC, whereby respondent no.2 has been acquitted. 3. Vide order dated 07.02.2025, it was noted, respondent no.2/accused may be dead. 4. Vide his report dated 20.03.2025, the learned CJM, Agra has reported that the said accused died on 08.01.2024. 5. In view of the above, the present appeal does not survive. The appeal is declared abated. 6. Accordingly, the present appeal is consigned to record.
