By the present writ petition, the petitioner who was working on the post of Headmaster (Primary School) at Government Primary School, Ghatmadawa, Block Kasdol, District Baloda Bazar-Bhatapara retired on 31/01/2023, seeking a direction towards the respondent No.2 to take a decision on the recommendation dated 12/06/2024, issued by the Office of D.E.O./respondent No.4 by certifying the actual date of birth of the petitioner as 01/02/1961.

Learned counsel for the petitioner submits that the case of the pension as well as the retiral dues of the petitioner are not being finalize only on the ground that there is some overwriting in the date of birth of the petitioner in the service record. He submits that in spite of the recommendation of the D.E.O. dated 12/06/2024, certifying the actual date of birth of the petitioner as 01/02/1961, still the respondent No.2 is not taking any decision on the said recommendation and the petitioner is being deprived from the retiral dues as well as the pension and gratuity.

Learned counsel for the respondent/State submits that from the communication dated 12/06/2024 it appears that the District
3 Education Officer has recommended and certified the actual date of birth of the petitioner as 01/02/1961. He further submits that the petitioner has also submitted a representation to the respondent No.2 on 20/08/2024 and if the representation is still pending before the respondent No.2, the same shall be considered in accordance with law.
4. I have heard learned counsel for the parties, perused the pleadings and documents.

In view of submission made by learned counsel for the State that the respondent No.2 will consider the grievance of the petitioner on the basis of recommendation submitted by the D.E.O., the writ petition is disposed of with a direction to the respondent No.2/Director, Directorate of Public Instruction to take a decision on the recommendation made by the D.E.O. dated 12/06/2024, by which, the D.E.O. has certified the actual date of birth of the petitioner as 01/02/1961. The respondents are directed to finalize the pension as well as retiral dues of the petitioner within a period of 60 days from the receipt of copy of this order.
6. With the aforesaid observation, the writ petition stands
