THE TAHSILDAR, THOTTEMBEDU (MANDAL) TURUPATI DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the Respondents in considering the Petitioner's representation dated 24.02.2025, in respect of land measuring Ac.4.50 cents in Survey No. 132/5 (Part) of Vikruthamala Village, Yerpedu Mandal, Tirupati District, as illegal, arbitrary, unjust, unconstitutional, violative of the principles of natural justice and contrary to Articles 14, 19, 21 and 300-A of the Constitution of India, and consequently direct the Respondents to consider the Petitioner's representation dated 24.02.2025 and pass appropriate orders in accordance with law, and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents not to interfere with the peaceful possession and enjoyment of the Petitioner over the subject land measuring Ac.4.50 cents in Survey No. 132/5 2 (Part), situated at Vikruthamala Village, Yerpedu Mandal, Tirupati District, pending disposal of the above Writ Petition, and pass Counsel for the Petitioner: 1. GP FOR REVENUE 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.28102 of 2025 ORDER:- The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the Respondents in considering the Petitioner's representation dated 24.02.2025, in respect of land measuring Ac.4.50 cents in Survey No.132/5 (Part) of Vikruthamala Village, Yerpedu Mandal, Tirupati District, as illegal, arbitrary, unjust, unconstitutional, violative of the principles of natural justice and contrary to Articles 14, 19, 21 and 300-A of the Constitution of India, and consequently direct the Respondents to consider the Petitioner's representation dated 24.02.2025 and pass such other order or orders.…” 2. It is the case of the petitioner that an extent of Ac.4.50 cents in Survey No.132/5 (Part) of Vikruthamala Village, Yerpedu Mandal, Tirupati District, was assigned in favour of petitioner vide D.K.T. No.159/4/1991. Since then, petitioner has been in possession of the property and has been enjoying the produce by cultivating the said land. Petitioner made an application dated 30.12.2023 under Right to Information Act, to which the concerned authorities responded and admitted that land was allotted in the year 1991 in the name of petitioner. 3. Thereafter, the respondents finally sent the report bearing Roc.No.D/74/2025, dated 14.07.2025 to petitioner’s mobile number, clearly confirming that D-patta was issued in favour of petitioner for an 4 extent of Ac.4.50 cents in Survey No.132/5 (Part) of Vikruthamala Village, Yerpedu Mandal, Tirupati District. Respondent No.2 also issued instructions to respondent No.3 stating that D-form patta is found to be genuine and that the petitioner is eligible for compensation/ex gratia. Petitioner submitted representation dated 24.02.2025 for payment of compensation/ex gratia. As there is no response from the respondents, present writ petition came to be filed seeking a direction to respondent authorities to consider the representation dated 24.02.2025 for payment of compensation/ex gratia. 4. Heard Sri Bhargav Thimmaraju, learned counsel for petitioner and learned Assistant Government Pleader for Revenue for respondents. 5. Learned counsel for petitioner submits that it would suffice to direct the respondents to consider the petitioner’s representation dated 24.02.2025. 6. Learned Assistant Government Pleader does not refute the said submission. 7. Therefore, without going into merits of the matter, the present Writ Petition is disposed of at the admission stage, directing respondent No.3 to examine the petitioner’s representation dated 24.02.2025, pass appropriate orders in accordance with law, and 5 communicate the decision to the petitioner as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
