(ORAL) The prayer made in the present petition was for seeking the pensionary benefits by deeming the pay of the petitioner to the post of Under Secretary. On being confronted with the fact that the petitioner had earlier approached this Court vide CWP No.4500 of 2015 claiming the benefit of relaxation to be promoted to the post of Under Secretary, which such claim was specifically declined. The counsel for the petitioner had also raised an argument that the petitioner has held Current Duty Charge to the post of Under Secretary and that she is entitled to the salary for the said post. The aforesaid prayer of the petitioner was accepted by the Bench only to the limited extent that she may be granted the salary for the period during which she discharged the duties of the post of Under Secretary on Current Duty Charge. By necessary inference, it would flow that the claim of the petitioner for the retiral dues/benefits with respect to the post of Under Secretary and recalculation thereof had been denied. A separate writ petition for the same cause of action would thus not be maintainable.
