The petitioner is before this Court seeking for the following reliefs: a) Issue Writ of Certiorari and quash the Notice dated.20.05.2025 issued by the respondent (produced vide ANNEXURE-C) to the writ petition; and b) Issue any other writ or order or orders as this Hon'ble Court be deems fit it necessary under the facts and circumstances of the case in the interest of justice and equity. 2. The petitioner is a recreation club carrying on its business at Aralahalli, Kasaba Hobli, Holalkere Taluk, Chitradurga District. The petitioner is before this Court aggrieved by the notice dated 20.05.2025 at Annexure-C by virtue of which respondent had called upon the petitioner to furnish the CCTV footage for last 15 days and continue to submit the same every 15 days. 3. The submission of learned counsel for the petitioner is that if such footage is required to be furnished with such - 3 - HC-KAR NC: 2025:KHC:50265 WP No. 16597 of 2025 frequency there would be a huge financial burden on the petitioner. The petitioner would however undertake to furnish such CCTV footage as may be required in connection with any particular enquiry, action or investigation taken up by the respondent within 24 hours of such requisition. The submission of learned counsel for the petitioner is also that the petitioner shall maintain the CCTV recording for the last 15 days and will not delete or tamper with any such recording. 4. In my considered opinion the said submission of learned counsel for the petitioner would answer the requirement of the respondent inasmuch as there would be no particular requirement for the petitioner to furnish the CCTV footage every 15 days without any incident occurring at the place of the petitioner and or there being no enquiry or investigation by respondent. It is only when the respondent requires any particular footage of a particular date or time, the respondent can call upon the petitioner to furnish the same. In that view of the matter, I pass the following: - 4 - HC-KAR NC: 2025:KHC:50265 WP No. 16597 of 2025 ORDER i) The Writ Petition is allowed. ii) A certiorari is issued, the notice dated 20.05.2025 issued by the Respondent at Annexure-C is quashed. iii) The petitioner is directed to continue to retain all the CCTV footage of all the cameras installed at the premises of the petitioner for a minimum period of 15 days and make available the same to the respondent as and when called upon to do so.
