The petitioner has prayed for a writ of mandamus commanding CJM, Baghpat to transmit the service book of deceased employee, Subhash Sharma, son of Anand Swaroop Sharma to Principal, Sri Vidhya Mandir Junior High School, Tyorhi, District Baghpat. 2. The case of the petitioner is that her late husband is an accused in the case pending before CJM. His service book being part of investigation, was submitted by the investigating agency before the Magistrate while filing the charge sheet. The petitioner has filed application before CJM to transmit the service book to the Principal of the Institution. As the application has not been disposed of, the present petition has been filed. 3. As the service book is part of the investigation and the case is still pending before CJM, therefore, we do not consider it appropriate to issue any direction in exercise of writ jurisdiction. We leave it open to the petitioner to press the application said to be pending before the CJM and in that event, the CJM will consider and dispose of the application expeditiously. 4.
