ORAL ORDER:
Heard Sri S. Prem, learned Counsel appearing on behalf of Sri V. Rama Chandra Reddy, learned Counsel for the Writ Petitioners and Sri K. Arjun Chowdhary, learned Assistant Government Pleader for Revenue. 2. Sri K. Arjun Chowdhary, Learned Assistant Government Pleader for Revenue has submitted the Written Instruction furnished by the Tahsildar of Bhogapuram dated 10.02.2025. Copy of it is served on the Counsel for the Writ Petitioners as well. This Written Instruction is taken on record. The relevant portion of the said Written Instruction is usefully extracted hereunder:
“It is submitted that the writ petition scheduled land is situated in Cherukupalli Village, Bhogapuram Mandal, Vizianagaram District. As per SFA records, the land in Sy.No.1/1 measuring Ac.53.95 Cts. is classified as Konda Poramboke (Govt. Land).
It is further submitted that certain individuals have been granted/assigned House Site Pattas in the subject land along with the present Writ Petitioners. Further, it is submitted the field staff of this office has conducted physical inspection with regard to ascertain the availability of Govt. Land in Sy.No.1/1 of Cherukupalli Village and also to identify encroachments, if any. At this juncture, it is to submit that this respondent never tried to dispossess/threatened any individual or even the present Writ Petitioners from the said land. Further, it is to submit that, only on physical verification over the land by the field staff, the petitioners has unnecessarily apprehended that they will be disposed/vacate from the petition scheduled land and thereafter filed this Writ Petition with a false plea and thereby misled the Hon'ble High Court with a malafide intention. Hence the contention of the Writ Petitioner is false and baseless and deserves no
consideration, as there is devoid of merits.”

The above extract would indicate that the Revenue Officials have only conducted the physical inspection for ascertaining the availability of Government land in Sy.No.1/1 of Cherukupalli Village and also to identify the encroachments, if any. It is also stated in the Written Instructions that the Official Respondents have not attempted to dispossess the Writ Petitioners from the subject land and that due to physical inspection of the land, the Writ Petitioners have unnecessarily apprehended that they will be dispossessed from the subject land.

Having regard to the above extract, this Court deems it appropriate to dispose of this Writ Petition, at the admission stage, without going into the merit, directing the Official Respondents to follow the due process of law if any coercive step is sought to be initiated against the Writ Petitioners in the future.
5. With these observations and directions, this Writ Petition stands
disposed of. No order as to costs.
6. Interlocutory Applications, if any, stand closed in terms of this order.
