The present Criminal Revision Case, filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘Cr.P.C.'), is preferred by the petitioner/accused, challenging the Judgment dated 26.11.2013 passed in Crl.A.No.41 of 2013 by the learned Sessions Judge, Prakasam Division, Ongole (for short, ‘the 1st Appellate Court’). By the said Judgment, the 1st Appellate Court dismissed the appeal, confirming the Judgment of conviction and sentence passed by the learned Judicial Magistrate of First Class, Special Mobile Court, Ongole, (for short, the ‘Trial Court’) in C.C.No.81 of 2008 dated 06.02.2013. 2. Today, when the matter was taken up for hearing, the learned counsel for the petitioner/accused appeared. 3. The learned Assistant Public Prosecutor, representing the 1st respondent/State, submitted the Trial Court’s report. A perusal of the report indicates that the accused died on 31.03.2021 due to ill-health at Sanghamithra Hospital, Ongole; the Sub Inspector of Police, Maddipadu police station filed another memo stating that he made enquires at the accused’s residence and confirmed the death of the accused. 3 4. In view of the death of the petitioner/accused, the Criminal Revision Case is dismissed as abated. Interim orders, if any, granted earlier shall stand vacated, and all pending miscellaneous petitions, if any, shall stand closed. ________________________ T.
