The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 445/2024, registered at Police Station- Balconagar, District- Korba (CG) for the offence punishable under Section 103(1) of BNS, 2023. 2. First Bail Application bearing MCRC No. 14 of 2025 was 2 dismissed for want of prosecution by this Court on 22.01.2025. 3. The prosecution story in brief, is that on 15.09.2024 the complainant Rajni Jaiswal appeared at the police station and lodged a report that her husband, Bhubaneshwar Jaiswal, had been missing since 14.09.2024 at 8:00 pm upon which the police registered a missing report no. 83/2024 and took it up for investigation. During investigation, Rajni Jaiswal and Harish Jaiswal expressed suspicion on the present applicant Satish Kathle. When Satish Kathle was taken into custody and interrogated, he disclosed that he had murdered Bhubaneshwar Jaiswal and had disposed of his body. Thereafter, on the identification of Satish Kathle, a dead body was recovered near old ash dam at Naya Risda Bhadrapara which was identified by Harish Jaiswal as the body of his younger brother Bhubaneshwar Jaiswal. At the spot, a small knife, matchbox, disposable glass with petrol smell were seized. The motorcycle used in the commission of the crime bearing registration no. CG 12 AN 0563 along with a Redmi company mobile phone a T-shirt, and a lower were also seized from the accused. The police of Police Station- Balconagar registered FIR bearing Crime No. 445/2024 and arrested the present applicant on 15.09.2024 for commission of offence under Section 103(1) of BNS, 2023 and after completion of the entire investigation, charge sheet has been filed and presently the case is pending before the learned Additional Sessions Judge, Korba, District- Korba (C.G.) as Sessions Trial 3 No. 01/2025. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. He further contended that the applicant is in custody since 15.09.2024 and has presented the deposition sheets of the witnesses examined by the trial court. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Also, there is no substantial change in the circumstances of the case. Accordingly, the bail application of applicant- Satish Kathle involved in Crime No. 445/2024 under Section 103(1) of BNS, 2023 at Police Station- Balconagar, District- Korba, Chhattisgarh, is rejected. 8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible, in accordance with law, if there is no legal impediment. 4 9.
