PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.16 of 2025 of Araku Police Station, Visakhapatnam District, registered for the alleged offence punishable under Sections 61(2), 103(1), 2 115(2), 118(1) and 351(3) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The allegation against the petitioner/accused No.3, is that he, along with other accused, went to the house of the defacto complainant’s parents and assaulted her father with sticks and stones on the ground that he was practicing sorcery and witchcraft (black magic) and was responsible for the death of the defacto complainant’s senior maternal aunt. Specific overt acts have been attributed to the petitioner. The investigation has been completed, and the charge sheet has been filed. P.R.C. No.20 of 2025 is pending for committal. Accused Nos. 1, 2, and 4 to 9 were granted regular bail after the completion of the statutory period. 4. Considering the facts and circumstances, the gravity and nature of the allegations levelled against the Petitioner, this Court is not inclined to grant pre-arrest bail to the Petitioner/ Accused No.3. 5. In the result, the Criminal Petition is dismissed. However, as per the request of the learned counsel for the petitioner/accused No.3, liberty is granted to the petitioner/accused No.3 to surrender before the learned Jurisdictional Court concerned within one (01) week from the date of receipt of copy of this order, and move an appropriate application before the learned Jurisdictional Court concerned. The learned Jurisdictional Court concerned is 3 directed to dispose of the said application in accordance with law, on its own merits by giving due and sufficient opportunity to the learned Public Prosecutor concerned, and pass appropriate orders within a reasonable time, as far as possible preferably in two (02) days. ________________________ Dr.Y.
